Discharge of Old Tax Debt

Treating all tax debt arising from untimely filed tax returns as nondischargeable per se is fundamentally wrong. Otherwise, the IRS itself would not reject the one-day-late rule and criticize it for being “overly harsh.” There are circumstances when taxpayers should be able to discharge debt from untimely returns.
